On February 27, 2017, Anahuacalmecac school administrators responded to parent concerns and reports of intimidation by the dispensary's personnel by issuing a letter to the Los Angeles City Attorney and Mayor calling for the immediate closure of the establishment located at 5014 Huntington Drive, Los Angeles, Ca 90032 known as 25 CAP. Shortly thereafter, community members started a petition to raise attention on the issue. City officials including the local city councilman's office, LAPD and the City Attorney's Neighborhood Prosecutor have met with parents, students and administrators but say not much can be done. Our community expects the safety of children and the constitutionally guaranteed protection of school safe zones to be given the utmost priority. Nothing less than the immediate closure of any and all marijuana dispensaries in flagrant violation of current laws decriminalizing marijuana use will be accepted.
Additionally, we reaffirm that the marijuana business' continued illicit operation violates the civil rights of our children impeding their access to a safe school environment as guaranteed by the Constitution of the State of California as the "Right to Safe Schools: All students and staff of public primary, elementary, junior high, and senior high schools, and community colleges, colleges, and universities have the inalienable right to attend campuses which are safe, secure and peaceful."
Parents remain urgently alarmed by the violation of the community's constitutionally guaranteed rights to a safe school community caused by the opening and publicly acknowledged operation of a marijuana business flagrantly illegally operating within 300 feet of our kindergarten, on the backside of two churches and within steps of a preschool. The aggressive operation of a marijuana business operates in violation of the restrictions placed on such establishments around schools, churches and community centers violates our constitutionally guaranteed unalienable right to safe schools. Heavily armed guards, strangers loitering and the increased risks of violence associated with these locations violate the rights of our children to safe school communities and safe passage to and from school.
Proposition D stipulates that, "In addition to meeting all the requirements for immunity, a medical marijuana business cannot locate within a 1000 feet radius of a school or within a 600 feet radius of a public park, public library, religious institution, child care facility, youth center, alcoholism, drug abuse recovery or treatment facility or other medical marijuana business. On Feb. 27, 2017 Notice was sent to LA City Attorney by AIUP Administration regarding a marijuana business has been opened within 500 feet of our elementary school charter school campuses located at 4970 and 4990 Huntington Drive in El Sereno 90032.
We call upon you to see that this business is closed in accordance with the law and to prosecute the property owner for willfully violating the city ordinance. The property subject in question is located at 5014 Huntington Drive S., LA, CA 90032.
On March 6, 2017, the City Attorney's office responded anonymously that, “We have confirmed the presence of a marijuana business at this location and are addressing it.” Since then, parents have been harassed by dispensary armed security guards and responses have been mixed from city officials.
As of March 13, 2017, the City Attorney’s office has acknowledged that the dispensary has not been shut down.
